By accepting this public offer, you agree to all the terms set forth below, confirm that you understand them, and enter into an agreement for the provision of services by “5D Academy”.
PUBLIC OFFER
5D Academy (represented by Sole Proprietor Kolesnikov Ruslan Serhiiovych) (hereinafter referred to as the “Service Provider”) offers individuals and legal entities (hereinafter referred to as the “User”) (collectively referred to as the “Parties”) to enter into this Public Offer Agreement (hereinafter referred to as the “Agreement”) under the terms specified herein and according to the selected services.
Acceptance of this Agreement is confirmed by conclusive actions, including ticking the checkbox “I have read and agree to the Public Offer” and/or making a payment for online courses and/or gaining access to educational materials. If you do not agree with the terms, entering into this Agreement is not possible.
1. Definitions
Platform – a system of educational materials размещed and administered by the Service Provider via www.academy5d.com.
Course – a set of theoretical and practical materials (videos, tasks, etc.).
Educational Materials – webinars, videos, presentations, seminars, etc.
Pricing – course pricing and conditions published on the Website or marketing materials.
Personal Account – a user account granting access to courses and materials.
2. Subject of the Agreement
The Service Provider agrees to provide access to the Platform and Educational Materials, and the User agrees to accept and pay for these services.
3. Agreement Conclusion
This Agreement is concluded upon acceptance of the offer by the User (payment or other conclusive actions).
4. Pricing and Payment
- The price depends on the selected course;
- Payments are made via online systems or bank transfer;
- Payments are processed in UAH equivalent;
- Payments are non-refundable;
- Discounts apply only before purchase;
5. Service Delivery
Services are provided online via access to the Platform.
The Service Provider is not responsible for missed sessions.
6. Obligations of the Parties
Service Provider:
- Provide access to services;
- Provide login credentials;
- Offer support via email or messaging platforms;
User:
- Pay for services;
- Use materials personally;
- Not share access or copy materials;
7. Intellectual Property
All materials and content belong to the Service Provider or are used under license.
8. Liability
The Service Provider may terminate access in case of violations.
Unauthorized sharing may result in a penalty of 500% of the course price.
9. Dispute Resolution
Disputes will be resolved through pre-trial settlement.
10. Term
The Agreement is valid for 1 year unless otherwise specified.
11. Other Terms
- The User consents to personal data processing;
- The Service Provider may update terms;
- Applicable law governs the Agreement;
