This Agreement is concluded between “5D Academy” (represented by Sole Proprietor Kolesnikov Ruslan Serhiiovych, hereinafter referred to as the “Academy”) and the individual who accepts this Public Offer by registering in the Affiliate Program on www.academy5d.com (hereinafter referred to as the “Partner”).
1. Subject of the Agreement
1.1. The Partner promotes the Academy’s educational products (courses and consultations) by placing a unique affiliate link on their websites, social media, blogs, or other online resources.
1.2. The Academy agrees to pay the Partner a commission for successful referrals.
2. Rights and Obligations of the Parties
2.1. The Academy agrees to:
- Ensure proper operation of the website;
- Register the Partner and provide a unique affiliate link;
- Track referrals and sales generated through the Partner;
- Pay commissions in accordance with Section 3;
- Provide support via email (info@academy5d.com);
- Request removal of misleading promotional content;
- Terminate the Agreement in case of violations or no sales within 6 months.
2.2. The Partner agrees to:
- Promote the Academy’s products using their own resources;
- Use their assigned tracking code correctly;
- Report technical issues immediately;
- Not use spam or unsolicited messaging;
- Not place links on third-party sites without permission;
- Not artificially generate traffic;
- Not harm the Academy’s reputation;
- Not use affiliate links for personal purchases.
3. Commission and Payments
- Commission is paid for completed purchases;
- Tracking period: 365 days from first click;
- Commission rate: 10% per sale;
- Custom terms may apply for large audiences (500,000+ followers);
- Earnings are tracked in real-time in the Partner’s account;
- Payouts are made monthly (1st–10th);
- Bank fees are covered by the Partner.
4. Special Terms
- Actions performed via login/password are legally binding;
- Email communication has legal validity;
- The Partner must update their details if changed;
- False information may result in termination without payout;
- Violation results in account suspension and ban;
- Prohibited content includes illegal, offensive, or harmful materials;
- The Partner bears full responsibility for risks and damages;
- The Academy may change pricing without notice.
5. Force Majeure
Neither Party shall be liable for failure to perform due to circumstances beyond their control.
The affected Party must notify the other within 3 business days.
6. Dispute Resolution
All disputes shall be resolved through negotiations.
7. Term of the Agreement
This Agreement is valid for 1 year and is automatically renewed unless terminated 30 days prior.
The Academy may terminate the Agreement at any time with payment of earned commissions.
8. Other Terms
- Rights and obligations cannot be transferred without consent;
- The Academy may update the Agreement at any time;
- Communication is conducted via email.
